These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “customer,” or “user”) and Zjarr (“Zjarr,” “we,” “our,” or “us”) governing your access to and use of our website, products, and services.

By accessing, browsing, or purchasing from Zjarr, you expressly agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of our services.

1. RIGHT TO REFUSE SERVICE

Zjarr reserves the unrestricted right, at its sole discretion, to:

  • Refuse or cancel any order

  • Limit quantities purchased

  • Restrict or terminate accounts

  • Deny service to any individual or entity

This may occur without notice and without liability.

2. PRODUCT AVAILABILITY & PRICING AUTHORITY

  • All products are subject to availability and may be withdrawn at any time

  • Prices are subject to change without notice

  • We reserve the right to correct pricing errors, inaccuracies, or omissions at any time, including after an order has been submitted

Zjarr is not obligated to honor incorrect pricing or promotions.

3. ORDER ACCEPTANCE & CANCELLATION

  • Submission of an order does not guarantee acceptance

  • Zjarr may cancel or refuse any order for any reason, including suspected fraud or unauthorized activity

  • If payment has been processed, a refund will be issued at our discretion

 

4. SHIPPING, RISK OF LOSS & TITLE TRANSFER

  • All delivery timelines are estimates only

  • Once an order is transferred to the carrier, risk of loss and title passes immediately to the customer

  • Zjarr is not responsible for:

    • Lost, stolen, or delayed shipments

    • Carrier errors or delivery issues

    • Customs delays or fees

 

5. FINAL SALE & RETURN RESTRICTIONS

All sales are considered final unless explicitly stated otherwise.

If returns are permitted:

  • Items must meet strict eligibility requirements (unworn, unused, original condition)

  • Requests outside the stated return window will be automatically denied

  • Zjarr reserves the sole right to approve or deny any return, refund, or exchange

We do not guarantee refunds under any circumstances.

 

6. CHARGEBACK & FRAUD POLICY

  • Any chargeback or payment dispute will be considered a breach of these Terms

  • Zjarr reserves the right to:

    • Permanently ban the customer

    • Pursue recovery of funds, fees, and damages

    • Submit evidence to financial institutions to dispute claims

Fraudulent activity will be reported to applicable authorities.

 

7. INTELLECTUAL PROPERTY ENFORCEMENT

All intellectual property, including but not limited to:

  • Logos, branding, and trademarks

  • Designs, graphics, and product concepts

  • Website layout and content

are the exclusive property of Zjarr and are protected under applicable intellectual property laws.

Unauthorized use, reproduction, distribution, or imitation will result in legal action.

 

8. LIMITATION OF LIABILITY (MAXIMUM PROTECTION)

To the fullest extent permitted by law:

Zjarr shall not be liable for:

  • Any indirect, incidental, punitive, or consequential damages

  • Loss of profits, business, data, or opportunities

  • Injuries or damages arising from product use beyond intended purpose

Our total liability, under any circumstance, shall not exceed the amount paid for the product in question.

 

9. NO WARRANTIES

All products and services are provided “as is” and “as available”, without warranties of any kind, whether express or implied.

Zjarr expressly disclaims:

  • Implied warranties of merchantability

  • Fitness for a particular purpose

  • Non-infringement

 

10. USER RESPONSIBILITY & MISUSE

You agree:

  • Not to misuse products beyond intended purpose

  • Not to attempt reverse engineering, copying, or exploiting products

  • Not to use the website for unlawful or abusive conduct

Any violation may result in immediate termination of access and potential legal action.

 

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Zjarr from and against any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:

  • Your misuse of products or services

  • Your violation of these Terms

  • Your infringement of any third-party rights

 

12. FORCE MAJEURE

Zjarr shall not be held liable for any failure or delay in performance caused by events beyond our control, including but not limited to:

  • Natural disasters

  • Supply chain disruptions

  • Labor disputes

  • Government actions

 

13. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by the laws of the State of Nevada, United States.

All disputes shall be resolved exclusively through binding arbitration, and you waive any right to:

  • Jury trials

  • Class actions or collective claims

 

14. MODIFICATIONS TO TERMS

Zjarr reserves the right to update, modify, or replace these Terms at any time without prior notice.

Continued use of the website constitutes acceptance of updated Terms.

 

15. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain fully enforceable.
